Updated November 2026. Our guide to being between homes now starts with the paperwork that can close the gap: early occupancy and rent-back agreements. Texas forms checked on the TREC contracts page, November 1, 2026.
An early occupancy agreement is a short written contract that lets a buyer move in before closing, usually for a daily fee, a deposit and proof of insurance. In Texas it’s TREC form 16-7, the Buyer’s Temporary Residential Lease, in use since January 5, 2026. When the seller stays after closing instead, it’s a rent-back, form 15-7.
Selling and buying at once? Write the move-in dates into your offer. With a flat fee MLS listing (from $99 in most states, see your state page), you set and sign those terms yourself.

Key takeaways
- Possession normally passes at closing or funding. An early occupancy agreement moves it earlier.
- The buyer pays rent, puts down a deposit and carries insurance. The seller still owns the home.
- Texas uses mandatory TREC forms: 16-7 for buyers moving in early, 15-7 for sellers staying late.
- If the deal can fall apart, the agreement must say when and how the buyer moves out.
What is an early occupancy agreement?
It’s a temporary lease inside a home sale. The seller keeps the title, the buyer gets the keys early, and both sign terms for the days in between. Our glossary has the short early occupancy definition. This page is about using one.
Why would anyone do it? Usually because two dates don’t line up. The buyer’s lease ends on the 1st and closing is on the 20th. Or the buyer already sold and has a moving truck booked. Sometimes the seller has moved out and would rather collect rent than leave the house empty.
It’s a favor with real risk on both sides, so it should never be a handshake. Put it in writing, signed by both, before anyone hands over a key.
When does the buyer get possession of a property?
Whenever the contract says. Most purchase contracts give the buyer possession at closing and funding, in the condition it was in at signing, with normal wear allowed. Some set a later date, which is how a rent-back happens. The early-occupancy route sets an earlier one.
Possession isn’t the same as ownership. A buyer living in the home before closing is a tenant with permission. If the loan fails or the buyer walks, they don’t own anything, and the seller has to get them out. That’s why the agreement matters more than the move.
Texas spells this out with standard forms. The TREC contracts page lists the Buyer’s Temporary Residential Lease (16-7) and the Seller’s Temporary Residential Lease (15-7), both effective January 5, 2026. Texas licensees must use the TREC form for these situations. Selling there by owner? Our guide to drafting a FSBO contract in Texas shows where possession sits in the main contract. In other states, an attorney or your state’s standard forms cover it, and every Beycome seller gets state forms under Legal Forms in the dashboard.
What should an early occupancy addendum include?
Think about the day it goes wrong, then write that down. A solid agreement covers:
- The move-in date and the closing date, plus what happens if closing slips.
- A daily or monthly fee, and who it’s paid to.
- A security deposit, separate from earnest money.
- Insurance: the buyer’s renters policy for belongings and liability, the seller’s policy on the house.
- Utilities, whose name they’re in, and from which date.
- No changes to the home before closing: no painting, no demolition, no new locks.
- A walk-through and photos at move-in.
- A move-out deadline and daily holdover charge if the sale falls through.
Call your insurance agent before you sign. Policies treat a vacant home, a rented home and an owner-occupied home differently, and you don’t want to learn that after a pipe bursts. Ask the buyer’s lender too, since some lenders want to know about early move-ins.
| Buyer moves in early | Seller stays after closing (rent-back) | |
|---|---|---|
| Who owns the home | Seller | Buyer |
| Who is the tenant | Buyer | Seller |
| Texas form | TREC 16-7 | TREC 15-7 |
| Main risk | Deal fails with the buyer inside | Seller damages the home or won’t leave |
| Usual protection | Deposit, insurance, move-out deadline | Escrowed holdback, deposit, daily holdover fee |
How does a seller rent-back work?
It’s the mirror image. The sale closes, the buyer owns the house, and the seller stays on as a short-term tenant. It helps a seller who needs the sale money to buy the next home, or whose new place isn’t ready.
Keep it short and priced. One simple way to price it: the buyer’s monthly mortgage, taxes and insurance, divided by 30, per day. Many buyers ask for part of the seller’s proceeds to be held at closing until the keys come back. Agree on the move-out walk-through in advance.

Get up to 2% back at closing
On homes listed by other agents, Beycome credits you up to 2% of the price at closing (1% kept, $1,499 minimum; not on FSBO homes or homes listed by Beycome sellers).
Buy a home →The buyer’s lender has a say. A loan for a primary home assumes the buyer will move in, so a long rent-back can clash with the loan terms. Ask early. What if neither side can bend on dates?
Then you’re between homes for real, and your things need a place. The usual answer is a month-to-month unit. Look for self storage units for moving between homes that rent by the month and let you switch sizes. Check the Bolt Storage sizing guide before you book, so you don’t pay for more space than your things need.
Pack for a gap, not for a move. Label boxes by room, keep a “first week” box with you, and photograph the unit after loading. Our tips on organizing and storing your stuff before moving help, and moving to a smaller home covers what to let go.

Early occupancy and possession questions
What is an early occupancy agreement?
A short lease that lets the buyer move in before closing. It sets the fee, deposit, insurance, utilities, and what happens if the sale doesn’t close.
What is an early occupancy addendum?
The same terms attached to the purchase contract as an addendum. In Texas, the standard version is TREC’s Buyer’s Temporary Residential Lease, form 16-7.
What does possession of a property mean?
The right to live in and control the home. It usually passes to the buyer at closing and funding, unless the contract sets another date.
What is a rent-back when selling a house?
An agreement that lets the seller stay in the home after closing as a short-term tenant, usually for a daily fee and a holdback from the sale proceeds.
Is early occupancy a good idea for sellers?
It can be, with a written agreement, a deposit and the buyer’s insurance in place. The risk is a buyer living in the home when the sale fails.
Where do you put your stuff when you’re between homes?
Most people use a month-to-month storage unit, family space, or a short rent-back. An early occupancy deal can remove the gap entirely.
Can I avoid storage by buying before I sell?
Yes, if you can carry two homes for a while or qualify for a bridge option. A rent-back on your sale is another way to move once.
