What is Implied Warranty of Habitability?

The implied warranty of habitability is a legal concept that implies that a landlord must maintain rental property in a condition that is suitable for human habitation. This includes providing basic amenities like running water, heat, and electricity, as well as ensuring that the property is safe and sanitary. This warranty is implied in all residential leases, even if it is not explicitly stated in the lease agreement. Tenants can use this warranty as a defense in case the landlord fails to fulfill it's responsibility.
