What North Carolina rules apply to a FSBO sale?
Disclosure statements. Under N.C.G.S. 47E-4, owners give the buyer the Residential Property and Owners’ Association Disclosure Statement developed by the North Carolina Real Estate Commission. You can say you know of a condition, don’t, or make no representation. Under 47E-5, if the statements aren’t delivered before or when the buyer makes an offer, the buyer may cancel the contract within a short window, without penalty.
Excise tax. N.C.G.S. 105-228.30 sets the tax at $1 for each $500 or fraction of the price, paid by the seller to the county register of deeds before the deed is recorded. On $332,200 that’s $665.
